Contracts back on agenda

Here's the agenda for tonight's City Council meeting. Police Chief William Matthews and City Manager Harry Walker's contracts are expected to be discussed.

But remember what happened two weeks ago.

The action item for Matthews is to amend his contract.

Actually the Coatesville City Council needs to rehire Matthews. According to the wording of his contract his contract was terminated on May 23, 2008 see the contract wording below:

The City and Matthews agree that Matthews will obtain valid certification under Act 120 as a police officer within six (6) months of the date of this Agreement, unless the priorities of the city or the responsibilities of the position requires the time and attention that would otherwise be devoted to the process of obtaining more immediate certification. Such determination of priorities shall be made by the City, after consultation with Matthews, and if such determination is made, Matthews shall have twelve (12) months to obtain certification. The parties further agree that in the event such certification is not obtained within said twelve (12) month period, this agreement will terminate immediately and the City shall have no further obligation to Matthews, unless the parties agree otherwise in writing.

Can you please explain to me why we need to do that 1:21? Matthews was hired in April of 2007. Per his contract he needed to obtain certification under ACT 120. This was not done. So he is in breech of his contract. Further he claims a medical injury prevents him from completing his certification but won't disclose what it is? Now you point out that per the wording of the contract that it terminated on May 23rd. That being said there is no reason to rehire Matthews. We have already have a chief in waiting (Cavale) who is certified. There is no firing no buyout. Even Matthews has praised Cavale as a cop in the DL article about him so it simply makes sense. Whereas if we rehire him then what we are essentially saying is that if you sign a contract in Coatesville don't worry you don't need to abide by it cause we'll never do anything about it. Its funny so many people (including myself) have raised about making changes to help makes the community better. I'm not saying that Matthews is bad man however what I'm saying is that this experiment simply hasn't worked and its time to move on. If you want things to be better then we need to raise the bar and awareness here.

As far as I'm concerned Mr Matthews is unemployed as of midnight 5/22.

The contract used the word
( WILL ) not could.

I heard they renewed his contract tonight . That won't work.

You can't renew when a contract ends by termination.

You have too start new.

I see legal challage folks

I suspect that Mr. Matthews age has more to do with him not being certified than any supposed injury he allegedly has. I wonder if there is any way that the district attorney or the state attorney general can get involved in this since Matthews is in violation of Act 120.
