MARTYNICK STAYS SEATED

Planning Commission member George Martynick will not voluntarily resign his seat, as requested by Council President Henry Wagner (D-Middle).

In an e-mail message sent late Sunday evening, Martynick stated simply, “I respectfully decline your request to resign from my recent reappointment to the Phoenixville Planning Commission.”

Martynick’s reappointment to his expiring term was made by Borough Council on January 15.

But Wagner had requested his resignation last Wednesday, to complement the resignation of former Council President John Messina. Messina had been appointed to the Commission slot now held by Michael Hott but expiring, like Martynick’s, in March.

The resignations were to pave the way for Borough Council to interview all current applicants for the two Commission seats. Interviews originally had been planned by Council but were scuttled on the procedural motion by Richard Mark Kirkner (D-North) that led to the selection of Messina on February 12.

“I ask you to consider voluntarily submitting your resignation from your recent appointment to the Phoenixville Planning Commission,” Wagner wrote to Martynick, “in order to allow for interviews of all interested citizens of Phoenixville to take place.

A return to interviews with Messina, Hott and paralegal Michelle Beaver was suggested first by Messina, who had been faced with immediate outcry over his own appointment without interviews. He argued that interviewing for not just his own but both expiring March seats “would be the only fair way” to approach the issue.

Martynick’s Sunday evening response to Wagner was made just prior to Council’s monthly Committees session, beginning at 7:00 p.m. tonight in its chambers, when Council will determine its next steps in the affair.

I don't blame him - he shouldn't resign. There were no other applicants for his seat, as I understand.

Council wanting him to resign also is just them trying to CYA for the Messina mess.

This could be the end for Messina. Typical Messina move, to work the smoke filled room to get 1 of the 2positions instead of 1 of the 1. Let there be some hope that council will not appoint Messina, he should sit out a few decades

this wlhole process got screwed up when king johns buddy kirkner pushed the issue to appoint the corrupt SOB. Then council further screwed the pooch by allowing king john of all people to decide what is fair. After reading the macphee statements john should nrver hold a public seat again

They better appoint Messina.He is alot of things but hes not a lier.He calls a spade a spade and a punk a punk.I womder if all them Cry babies blogs are complianing about this . Bet ya not , its not their party.

Well, of course Martynick stays seated -- he was legally appointed to a position on the Planning Commission for a term of 4 years and there were no other applicants for that seat when he was appointed.

Why has the Phoenix not shared the Solictor's ruling on this legal matter? This is a legal matter and the public is paying for legal advice for just this type of situation.

My understanding of the law is that unless someone appointed to a Commission refused to show up for meetings and/or commits a crime, that person holds the seat for the term of service -- and even if the person doesn't show up or does commit a crime, they have a right to a hearing so that the facts of the case can be laid before the public.

There is no reason for Martynick to do anything but serve out his appointed term on the Planning Commission.

I was thinking this would happen. Mr. Messina should have never resigned.This has really gotten alot of winners teed off.We are going down to the meeting now . Hope it wont be to late to voice our opinions .They should, if they can, make this boy interveiw for the job.

Martynick should NOT resign. When he was appointed, there were NO other individuals expressing an interest in serving. NONE. If this were to go down the way King John and his minions would like, then every time a new interested party expressed interest, all currently appointed Commission members should resign to see if council wants to take one of their seats for a crony. Ridiculous. If Messina is appointed after what we now know about his PPG dealings, all other members should resign in protest.

It's sad that Martynick said that he was willing to be interviewed, than changed his mind for whatever reason. I can guess but it would be too political.

The only person that kept their word in this whole thing is Messina. He said he would resign and be interviewed and he did just that.

What about the citizen who applied for this position, Michelle Beaver. Despite all of this politic-ing, don't you think a citizen who is volunteering to serve on a public commission should be afforded the opportunity to be heard? She applied after George had already been apponted, as did Messina. If Messina knew this was coming, why didn't he apply in January? I read somewhere that he said he would replace Mike Hott, specifically. This just seems too coincidental, don't you think?

What someone needs to explain to me is this: What, exactly, did Messina previously do on the planning commission that was so spectacular that he deserves reappointment?

Last time I checked there was still a big, vacant lot in the middle of town that could be full of people patronizing Borough businesses.

John made a name for himself rubber stamping all of a certain developers projects. He was pretty good at it until he resigned. I am sure he still has some of the wrist strength by his technique may be a bit rusty. By the time the Barto Towers get ready for approval, he should be back in form.

I voted for Senley even though I am a Democrat. Why cant council and the democratic committee accept the result of the election and see that Messina should just go away quietly.

In the Phoenix, it says, "But Martynick refused to follow Messina’s lead. “When I came to the realization that there is a possibility that council could accept my resignation and not accept John’s, I could not put myself in that situation,” he said early Monday."

Now that council accepted Messina's resignation, does that mean Martynick will follow his lead and resign?

No. I serve at the will of Council and they voted 6-2 not to ask for more application and not send my name to committee to discuss it further. They then voted 8-0 to reappoint me to another 4 year term. I just want to serve on the Planning Commission, I don't want to be a part of any of these games.
